IN THE FINAL HOURS<\/font><\/strong> before Congress adjourned in 2006, President Bush signed the Military Commissions Act Of 2006<\/em><\/a>. In doing so, the Constitution was violated<\/em> and the principle of habeas corpus<\/em> which protects against unlawful and indefinite imprisonment was thrown to the wind. <\/p>\n

This Military Commissions Act Of 2006<\/em> gives the President absolute<\/em> power<\/a> to designate “enemy combatants.” <\/p>\n

Section 6 of the Military Commissions Act<\/em> strips those declared an “enemy combatant”<\/a> of the right to be heard in court to establish his or her innocence as guarded by the Constitutional principle of habeas corpus<\/em>. This Act<\/em> violates Article I, Section 9, Of The US Constitution<\/a>:<\/font><\/p>\n

—<\/font><\/strong> “The privilege of the writ of Habeas Corpus shall not be suspended unless when in cases of rebellion or invasion.”<\/font> —<\/font><\/strong><\/p>\n

Presently, the suspending of habeas corpus<\/em> will be applied to “non citizens.” But once one class of people is deprived of their rights it\u2019s only a matter of time before other groups are also deprived. Moreover, the Act’s \u201cenemy combatant\u201d designation applies to both<\/em> Americans & foreigners. <\/p>\n

Thus by establishing Military Tribunals<\/em> for “enemy combatants” – the Military Commissions Act<\/em> puts the US Military<\/em> in control of American citizens. <\/p>\n
